7. Relationship with Third Parties

The operation of certain features may depend on brokers, APIs, servers or external platforms. West Malcom LLC does not control or warrant the execution of orders, latency, internal policies of third parties or the operational continuity of external platforms.

Any contractual relationship between the user and third parties is independent and unrelated to West Malcom LLC.

8. Technological Risks

Automated systems may be affected by network failures, software errors, third-party updates, user device issues or cloud service interruptions. West Malcom LLC does not warrant uninterrupted availability or absence of errors.

9. Limitation of Liability

To the maximum extent permitted by law, West Malcom LLC shall not be liable for direct or indirect economic losses, lost profits, consequential damages, losses derived from the use of automated systems or from user errors.

Total liability shall not exceed the amounts actually paid by the user in the last twelve (12) months, if any.

10. Indemnity

The user shall hold West Malcom LLC, its managers, employees and collaborators harmless against any claim, damage, loss, cost or expense (including legal fees) derived from the improper use of the site or the services, from regulatory non-compliance or from the infringement of third-party rights.

11. Jurisdictional Restrictions

The site and the services are not intended for use by persons in jurisdictions where it is contrary to local regulations. It is the user's responsibility to ensure that their access and use comply with the legislation of their country of residence.

This Disclaimer is governed by the laws of the State of New Mexico (USA). For any dispute, the provisions of the Terms and Conditions regarding jurisdiction shall apply, without prejudice to the mandatory rights applicable to consumers.
