West Malcom LLC, owner of the YourSmartPilot project, respects and protects the privacy of users. This Policy informs about the processing of personal data collected through the site. For users located in the European Economic Area, Regulation (EU) 2016/679 (GDPR) applies. Use of the site implies acceptance of this Policy.

2. Purpose of the Processing

The data provided may be processed for: managing sign-up, account creation and access to the private area; managing the consent process and the user's electronic signature; managing email verification; providing access to the YourSmartPilot features and to copy-trading through third-party platforms; sending service-related communications; analyzing browsing and use of the site for statistical and improvement purposes; ensuring the security of the site; complying with applicable legal obligations.

The data will not be used for purposes other than those stated.

3. Legal Basis

Processing is carried out under: the consent of the data subject; the performance of a contract or pre-contractual measures (sign-up and provision of the service); compliance with legal obligations; the legitimate interest of the Controller in ensuring the security of the site and improving its services.

4. Categories of Data

Identification data (first and last names); contact data (email and phone); account and service-usage data (including the broker account number the user provides); electronic signature metadata (date, IP address, user agent, transaction identifier); IP address and browsing data; any other information voluntarily provided.

Special categories of data under Article 9 GDPR are not processed.

5. Retention

Data will be retained for the duration of the relationship with the user and, thereafter, for the periods required by applicable tax, commercial or legal liability regulations. Electronic signature records are retained as evidence of acceptance for the period legally required. After the periods expire, the data will be blocked or deleted.

6. Recipients and International Transfers

Generally, data is not shared with third parties, except: providers acting as data processors (hosting, transactional email, database, analytics) with whom the corresponding contracts are entered into; public authorities when there is a legal obligation.

IMPORTANT — International transfer: West Malcom LLC is established in the United States. The processing of data of users in the European Economic Area entails an international transfer of data outside the EEA. Such transfer is carried out with the appropriate safeguards provided by the GDPR (for example, standard contractual clauses or other valid mechanisms), intended to ensure an equivalent level of protection.

7. Data Subject Rights

The user may exercise rights of access, rectification, erasure, objection, restriction of processing, portability and withdrawal of consent at any time by sending a request to operations@westmalcom.com with a copy of a valid identification document.

EEA users have the right to lodge a complaint with their data protection supervisory authority.

8. Security

West Malcom LLC adopts appropriate technical and organizational measures to ensure a level of security appropriate to the risk (including, among others, password hashing and role-based access control), preventing alteration, loss or unauthorized access.

The site uses cookies in accordance with the Cookie Policy available on the site.

10. Accuracy of the Data

The user warrants that the data provided is truthful, accurate and up to date, and undertakes to communicate any modification, being responsible for the damages derived from inaccurate or false data.

West Malcom LLC reserves the right to modify this Policy to adapt it to legislative changes or changes in its practices. The version in force will be the one published on the site.
